Welcome to Prepared Bee. Prepared Bee is operated by EverCreative LLC ("Prepared Bee," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of preparedbee.com (the "Site") and your purchase of products or use of services made available through the Site.

By accessing the Site, creating an account, placing an order, or otherwise using our services, you agree to these Terms and to the policies incorporated into them by reference. If you do not agree with these Terms, please do not use the Site.

1. Eligibility and Use of the Site

You must be legally capable of entering into a binding agreement to make a purchase through the Site. If you are under the age of majority where you live, you may use the Site only with the involvement of a parent or legal guardian.

You agree to use the Site only for lawful purposes and in a manner that does not violate the rights of Prepared Bee or any third party.

You may not:

  • Use the Site for unlawful, fraudulent, abusive, or deceptive purposes;
  • Attempt to interfere with the operation, security, or integrity of the Site;
  • Attempt to gain unauthorized access to accounts, systems, networks, or information;
  • Introduce viruses, malicious code, or other harmful technologies;
  • Use automated tools to scrape, copy, harvest, or systematically extract Site content except as permitted by law or with our written authorization;
  • Impersonate another person or provide materially false information; or
  • Use the Site or its content in a manner that infringes intellectual property or other legal rights.

2. Products and Product Information

We make reasonable efforts to describe and display products accurately. However, product packaging, specifications, dimensions, colors, labeling, features, components, and other details may change from time to time, including changes made by manufacturers.

Images displayed on the Site are provided for general reference. Actual products or packaging may vary.

Product information provided by manufacturers, distributors, laboratories, or other third parties may be incorporated into our listings. We may update product descriptions when new information becomes available.

Unless expressly stated otherwise, information on the Site is provided for general informational purposes and should not be treated as professional medical, legal, safety, engineering, or other specialized advice.

3. Prices and Availability

Prices, promotions, product availability, and product specifications may change without notice.

We reserve the right to correct typographical errors, pricing errors, inaccurate product information, or other mistakes at any time, including after an order has been submitted.

If an item is incorrectly priced or materially misdescribed, we may contact you for instructions or cancel the affected item or order and issue any applicable refund.

Placing an item in your shopping cart does not reserve inventory or guarantee availability.

4. Orders and Order Acceptance

Submitting an order through the Site is an offer to purchase the products in your order. Receipt of an order confirmation does not necessarily constitute final acceptance of the order.

We reserve the right, where reasonably necessary, to refuse, limit, hold, or cancel an order. Reasons may include:

  • Product unavailability;
  • Pricing or listing errors;
  • Payment authorization problems;
  • Suspected fraud or unauthorized activity;
  • Shipping restrictions;
  • Quantity limitations;
  • Manufacturer or distributor restrictions; or
  • Other circumstances that reasonably prevent us from completing the transaction.

If we cancel an order after payment has been collected, we will issue the appropriate refund for the canceled portion of the order.

5. Payment

You agree to provide current, complete, and accurate billing, payment, and contact information when placing an order.

By providing a payment method, you represent that you are authorized to use it and authorize the applicable charges associated with your order, including product price, shipping charges, taxes, and other amounts disclosed during checkout.

Payments may be processed by Shopify and other third-party payment providers. Prepared Bee may not directly receive or store complete payment-card information.

6. Taxes

Applicable sales, use, or other taxes may be calculated and collected at checkout based on the order, shipping destination, and applicable law.

You are responsible for any taxes, duties, customs fees, import charges, or similar governmental charges that are not collected by us at checkout and that may apply to your purchase.

7. Shipping and Delivery

Shipping estimates are estimates unless expressly stated otherwise. Actual processing and delivery times may vary based on product availability, fulfillment location, carrier performance, weather, holidays, manufacturer delays, address verification, or other circumstances.

Some Prepared Bee products may be shipped directly by a manufacturer, distributor, warehouse, or other fulfillment partner. Products in the same order may therefore arrive in separate shipments.

You are responsible for providing an accurate and complete delivery address. Additional charges resulting from an incorrect or incomplete address, refused shipment, failed delivery, rerouting request, or similar issue may be the customer's responsibility as described in our Returns, Refunds & Warranty Policy.

If we are unable to ship an order within an applicable promised shipping period, we will handle the delay, cancellation, or refund as required by applicable law.

8. Risk of Loss and Delivery Issues

If an order is lost, damaged, incomplete, or incorrectly delivered, please contact Prepared Bee promptly so that we can review the matter with the applicable carrier or fulfillment provider.

We may request photographs, packaging information, tracking records, shipping labels, serial or lot numbers, or other reasonable documentation when investigating a delivery claim.

9. Returns, Refunds, Exchanges, and Final-Sale Products

Returns, refunds, exchanges, damaged-item claims, refused shipments, and final-sale products are governed by our Returns, Refunds & Warranty Policy, which is incorporated into these Terms.

In general, eligible merchandise may be returned within 30 days of delivery, subject to the conditions in that policy.

Certain products are final sale once shipped, including:

  • Food products, including MREs and emergency food;
  • Water storage containers;
  • Designated oversized products; and
  • All MIRA Safety products.

Final-sale restrictions generally apply to buyer's-remorse returns and do not eliminate remedies that may apply to confirmed fulfillment errors, shipping damage, defects, incorrect items, or missing merchandise.

For MRE STAR products, fulfillment-error claims must be reported within 30 days of the date the order was placed, subject to the requirements described in our Returns, Refunds & Warranty Policy.

10. Order Cancellations

If you wish to cancel an order, contact Prepared Bee as soon as possible.

We will make reasonable efforts to honor cancellation requests before fulfillment begins, but cancellation cannot be guaranteed once an order has entered processing, has been transmitted to a fulfillment partner, or has shipped.

Products designated as final sale become subject to the applicable final-sale provisions once shipped.

11. Manufacturer Warranties

Certain products may include warranties provided directly by their manufacturers. Manufacturer warranties are governed by the applicable manufacturer's terms, limitations, procedures, and coverage periods.

Prepared Bee is not a manufacturer warranty repair facility unless expressly stated otherwise. Where appropriate, we may assist by providing proof of purchase or manufacturer contact information.

Nothing in these Terms is intended to limit any warranty or consumer right that cannot lawfully be excluded.

12. Product Use and Customer Responsibility

You are responsible for reading and following manufacturer instructions, warnings, labels, manuals, maintenance requirements, expiration information, storage instructions, and other guidance provided with a product.

Products should be used only for their intended purpose and in accordance with applicable laws and manufacturer instructions.

Prepared Bee is not responsible for harm resulting from misuse, unauthorized modification, improper installation, improper storage, failure to follow instructions, or use contrary to manufacturer recommendations, except to the extent responsibility cannot legally be excluded.

13. Emergency Preparedness and Educational Information

Prepared Bee may publish articles, guides, calculators, checklists, product comparisons, and other educational information relating to emergency preparedness, food storage, equipment, and related topics.

This material is provided for general educational purposes only. Conditions, needs, regulations, risks, shelf life, storage requirements, and appropriate preparedness measures vary by person, location, product, and situation.

You remain responsible for evaluating your own circumstances and following applicable government guidance, manufacturer instructions, professional advice, and local laws where appropriate.

14. Reviews and User-Submitted Content

If you submit a product review, comment, photograph, suggestion, feedback, or other content to Prepared Bee, you represent that you have the right to provide that content and that it does not violate the rights of another person.

You grant Prepared Bee a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, and distribute such content in connection with our business and marketing, subject to applicable law and our Privacy Policy.

We may remove or decline to publish content that we reasonably believe is unlawful, fraudulent, abusive, misleading, infringing, or otherwise inappropriate.

15. Intellectual Property

The Site and its original content, design, text, graphics, logos, page layouts, photographs, videos, databases, and other materials are owned by Prepared Bee, its licensors, manufacturers, or other applicable rights holders and are protected by copyright, trademark, and other intellectual property laws.

You may use the Site for personal, non-commercial shopping and informational purposes. Except as permitted by law or with prior written authorization, you may not reproduce, republish, distribute, modify, sell, exploit, or create derivative works from protected Site content.

Third-party product names, logos, trademarks, and brands remain the property of their respective owners.

16. Third-Party Services and Links

The Site may contain links to or integrations with services operated by third parties, including payment processors, shipping providers, manufacturers, analytics providers, social-media platforms, and other service providers.

We are not responsible for the content, availability, security, or privacy practices of third-party websites or services that we do not control.

17. Privacy

Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.

18. Fraud, Abuse, and Chargebacks

We reserve the right to investigate orders or transactions that reasonably appear fraudulent, unauthorized, abusive, or inconsistent with these Terms.

Customers should contact Prepared Bee if they believe there is a problem with an order so that we have an opportunity to investigate and resolve the issue.

Nothing in these Terms limits a customer's lawful rights with their payment provider or under applicable consumer-protection law.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

EXCEPT FOR EXPRESS WARRANTIES PROVIDED BY PREPARED BEE OR AN APPLICABLE MANUFACTURER, WE DISCLAIM WARRANTIES THAT MAY OTHERWISE ARISE BY LAW TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE SITE WILL ALWAYS BE AVAILABLE, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PREPARED BEE, EVERCREATIVE LLC, AND THEIR OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO PREPARED BEE FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot legally be excluded or limited under applicable law.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Prepared Bee, EverCreative LLC, and their officers, employees, agents, and affiliates from claims, damages, liabilities, or reasonable expenses arising from your unlawful use of the Site, violation of these Terms, infringement of third-party rights, or misuse of products, except to the extent caused by Prepared Bee's own conduct or where such indemnification is prohibited by law.

22. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.

23. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

24. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

25. Changes to These Terms

We may update these Terms periodically to reflect changes to our business, products, policies, technologies, or legal requirements.

The current version will be posted on the Site with an updated "Last updated" date. Changes will apply prospectively unless otherwise required by law.
